Let\u2019s all yell \u201c<em>Hooray!<\/em>\u201d and pass the 30-round mags\u2026 Well, not quite yet. However, it is a step in the right direction for the defense of our Second Amendment rights and draconian attempts to limit magazine capacity.<\/p>\n<p>Last Friday, United States District Court Judge Robert Benitez ruled that California\u2019s ban on <a href=\"https:\/\/www.cheaperthandirt.com\/parts-and-accessories\/magazines\/?utm_source=blog.cheaperthandirt&amp;utm_medium=referral&amp;utm_campaign=judge-deals-californias-high-capacity-magazine-ban-a-killer-blow\" target=\"_blank\" rel=\"noreferrer noopener\">magazines<\/a> capable of holding more than 10 rounds violated the Second Amendment. His reasoning was the most interesting part \u2014 and a must read. According to the scholarly law dogs, likely this case will have to ultimately be decided by the Supreme Court of the United States (SCOTUS).<\/p>\n<p><em>Duncan v. Bonta is leading three additional cases which were also granted, vacated, and remanded by SCOTUS back to the lower courts. The Court\u2019s reasoning in each was based on its ruling in <\/em><em>New York State Rifle and Pistol Association v. Bruen<\/em>. In essence, that means SCOTUS has given the lower courts another chance to either reverse their decisions or add additional points to be considered, should it be considered by SCOTUS again.<\/p>\n<p>For <em>Duncan v. Bonta, the next stop will be the <\/em>Ninth Circuit Court of Appeals \u2014 a court with a <a href=\"https:\/\/www.law.com\/nationallawjournal\/2023\/04\/13\/how-liberal-is-the-9th-circuit-new-study-takes-deep-dive\/?slreturn=20230826132319#:~:text=His%20finding%3A%20the%20court%20is,conventional%20portrayal%2C%E2%80%9D%20Hellman%20said.\" target=\"_blank\" rel=\"noreferrer noopener\">history<\/a> that leans more than just a little to the left. In 2021, an en banc panel reversed Judge Benitez\u2019s decision and upheld the restriction as constitutional, so I would not be too hopeful that the court will rule in Second Amendment advocates\u2019 favor this time.<\/p>\n<p>Previously, Judge Susan P. Graber\u00a0<a href=\"https:\/\/dl.airtable.com\/.attachments\/af02b88c564d6f26aa54cba106343469\/66d3d2e1\/DuncanvBontaEnBancOpinion.pdf\" target=\"_blank\" rel=\"noreferrer noopener\" class=\"broken_link\">wrote for a 7\u20134 majority of the Ninth Circuit<\/a>, \u201cNothing in the\u00a0record suggests that the restriction imposes any more than a <em>minimal burden<\/em> on the Second Amendment right to keep and bear arms. Similarly, the record suggests at most a minimal burden, if any burden at all, on the right of self-defense in the home.\u201d<\/p>\n<p>There is a concept known as a two-step test that weighs the state\u2019s interest in supporting the law against the infringement on the citizen\u2019s rights. This is where the populous divides and takes sides. However, SCOTUS struck down this old test and instituted a new one in\u00a0<em>Bruen<\/em>\u00a0decision last year.<\/p>\n<p>Instead of doing the balancing act between the state and citizens, the new test relies on determining whether any modern regulation is a close fit with those that existed when the Second Amendment was written. Benitez went on to point out that the laws at the time the Founding Era (when the Constitution was written) operated exactly opposite of California\u2019s ammunition restriction.<\/p>\n<p>\u201cThe right to have firearms for social security was important at the time the Constitution was adopted,\u201d Benitez wrote. \u201cThere were many enemies of the young nation. An armed citizenry provided a much-needed deterrent effect. Early citizens remembered how the Minutemen of Lexington and Concord, Massachusetts, by assembling as a militia, fought back against the hostile British march to take away guns and gunpowder in April 1776.<\/p>\n<p>\u201c<strong>These and other citizen militia laws demonstrate that, contrary to the idea of a firing-capacity upper limit on the number of rounds permitted, there was a legal obligation for the average citizen to have at least 20 rounds available for immediate use,\u201d he continued. \u201cThere were no upper limits like \u00a7 32310; there were floors, and the floors were well above 10 rounds. California\u2019s large capacity magazine ban is a diametrically opposed analogue.\u201d<\/strong><\/p>\n<p>\u201cWe are delighted with this ruling,\u201d Alan Gottlieb, founder of the Second Amendment Foundation, said in a statement. \u201cThe decision affects Washington Attorney General Bob Ferguson\u2019s defense against a lawsuit challenging a similar ban in his state, which is also in the Ninth Circuit, as well as bans in other states.\u201d Gottlieb went on to predict the case will have to ultimately be decided by the Supreme Court of the United States.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><img decoding=\"async\" loading=\"lazy\" width=\"400\" height=\"181\" alt=\"Second Amendment Foundation logo and address\" class=\"wp-image-8062 jetpack-lazy-image\" data-recalc-dims=\"1\" srcset=\"https:\/\/i0.wp.com\/blog.cheaperthandirt.com\/wp-content\/uploads\/2017\/11\/SAF-Wins-Permanent-Injunction.jpg?w=400&amp;ssl=1 400w, https:\/\/i0.wp.com\/blog.cheaperthandirt.com\/wp-content\/uploads\/2017\/11\/SAF-Wins-Permanent-Injunction.jpg?resize=300%2C136&amp;ssl=1 300w\" data-lazy-sizes=\"(max-width: 400px) 100vw, 400px\" src=\"https:\/\/i0.wp.com\/blog.cheaperthandirt.com\/wp-content\/uploads\/2017\/11\/SAF-Wins-Permanent-Injunction.jpg?resize=400%2C181&amp;is-pending-load=1#038;ssl=1\"\/><noscript><img decoding=\"async\" loading=\"lazy\" width=\"400\" height=\"181\" src=\"https:\/\/i0.wp.com\/blog.cheaperthandirt.com\/wp-content\/uploads\/2017\/11\/SAF-Wins-Permanent-Injunction.jpg?resize=400%2C181&amp;ssl=1\" alt=\"Second Amendment Foundation logo and address\" class=\"wp-image-8062\" srcset=\"https:\/\/i0.wp.com\/blog.cheaperthandirt.com\/wp-content\/uploads\/2017\/11\/SAF-Wins-Permanent-Injunction.jpg?w=400&amp;ssl=1 400w, https:\/\/i0.wp.com\/blog.cheaperthandirt.com\/wp-content\/uploads\/2017\/11\/SAF-Wins-Permanent-Injunction.jpg?resize=300%2C136&amp;ssl=1 300w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" data-recalc-dims=\"1\"\/><\/noscript><figcaption>Support those fighting for our rights!<\/figcaption><\/figure>\n<\/div>\n<p>Judge Benitez concluded his opinion by arguing the Second Amendment was \u201ca freedom calculus decided long ago by our first citizens\u201d that valued individual rights over the \u201csubservient security\u201d of the British monarchy or \u201csmothering safety of domestic lawmakers.\u201d He said that freedom was worth fighting for during the revolution and preserving today.<\/p>\n<p>\u201cOne government solution to a few mad men with guns is a law that makes into criminals responsible, law-abiding people wanting larger magazines simply to protect themselves,\u201d he wrote. \u201cThe history and tradition of the Second Amendment clearly supports state laws against the use or misuse of <a href=\"https:\/\/www.cheaperthandirt.com\/firearms\/?utm_source=blog.cheaperthandirt&amp;utm_medium=referral&amp;utm_campaign=judge-deals-californias-high-capacity-magazine-ban-a-killer-blow\" target=\"_blank\" rel=\"noreferrer noopener\">firearms<\/a> with unlawful intent, but not the disarmament of the law-abiding citizen.
